Terms of Service

Last updated: October 2026. This is a translation; the German version is legally binding.

1. Scope

These terms apply to your use of the iPhone app “TagegeldRechner” (the “App”), provided by Tobias Hann, Korbgasse 24/10, 1230 Vienna, Austria (“we”). Apple’s Licensed Application End User License Agreement also applies. Where the two conflict, these terms prevail to the extent Apple’s agreement allows.

2. What the App does

Based on your input, the App calculates the tax allowances for additional meal expenses under German law (§ 9 (4a) EStG) or the per diem (Tagesgeld) under Austrian law (§ 26 no. 4 EStG 1988). It uses the official rates for a specific year (“rule set”) stored in the respective App version.

The App expressly does not calculate: accommodation, travel or other travel costs; entitlements under an employment contract, collective agreement or works agreement; special cases such as the German three-month rule or a new centre of activity in Austria (the App only points these out); or payroll.

3. No tax or legal advice

The results are a guide only. They do not replace individual advice from a tax adviser, payroll department or lawyer and are not tax or legal advice. Only the statutory provisions and the decisions of the competent authorities are authoritative. Please check the results before using them in an expense claim or tax return.

4. Free use and TagegeldRechner Pro

The first five successful calculations per app installation are free. Further calculations require the one-time in-app purchase “TagegeldRechner Pro”. Pro also unlocks saving trips, trip history, repeat trip, and PDF and CSV export. Purchases, payment, refunds and restoring purchases are handled exclusively through the Apple App Store under Apple’s terms. There is no subscription.

5. Up-to-date rates

Official rates usually change every year. We aim to provide new rates promptly through App updates but do not guarantee them by a particular date. The App does not calculate travel years without a verified rule set. Saved calculations are never changed afterwards with newer rates.

6. Liability

We are liable for damage we cause intentionally or through gross negligence. For personal injury and under the Austrian Product Liability Act (PHG) we are also liable for slight negligence or regardless of fault. Otherwise, liability for slight negligence is excluded to the extent permitted by law (in particular § 6 (1) no. 9 of the Austrian Consumer Protection Act, KSchG).

As the results are expressly a guide only (section 3), we are not liable for additional tax, interest or other disadvantages resulting from using the results without checking them – except in cases of intent or gross negligence.

7. Warranty

Your statutory warranty rights, in particular under the Austrian Consumer Warranty Act (VGG) for digital services, remain unaffected. Claims relating to the purchase (e.g. refunds) are handled by Apple; you can report defects in the App itself to us at any time at the email address below.

8. Rights of use

You receive a simple, non-transferable right to use the App for your own purposes. You may freely use the exports you create with the App, e.g. for expense claims to your employer or for your tax adviser.

9. Changes to these terms

We may update these terms for future App versions, for example when features or the law change. The current version is always available on this page.

10. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer habitually resident in another country, you keep the protection of that country’s mandatory provisions.

For consumers, the statutory place of jurisdiction applies (§ 14 KSchG). For businesses, the competent court in Vienna has jurisdiction.
